Use of AI Software on ArtStation
ArtStation has just released an update to our platform and terms of service where projects tagged using “NoAI” will automatically be assigned an HTML “NoAI” meta tag. This will explicitly disallow the use of the content by AI systems and mark the project so that they know they are not allowed to use it.
Why are all projects not tagged with “NoAI” by default? / Does that mean if I don’t use the tag, I am allowing it?
We believe artists should be free to decide how their art is used, and simultaneously we don’t want to become a gatekeeper with site terms that stifle AI research and commercialization when it respects artists’ choices and copyright law.
We want to give artists more control over their publicly posted work. If you do not use the tag, you are neither allowing nor disallowing the use of your project for AI. Choosing not to use the tag leaves copyright law to govern whether or not the artwork was fairly used. AI’s use and its place in copyright law is new and unsettled, leaving open many questions about copyright law’s enforceability against use of work in AI. Adding the “NoAI” tag empowers you to clarify that regardless of the state of copyright law, use of your work in AI is not permitted.
What can I do if I don’t want to see AI artwork on the trending wall?
We’ve been working on changes over the past few months to create a more personalized homepage for the wide range of artists who use the platform. While we won’t be able to release these changes before the end of the year, we are experimenting with different ways of giving users more control over what they see and how they browse ArtStation.
Will ArtStation be banning AI artwork? / Is AI artwork allowed on ArtStation?
ArtStation’s content guidelines do not prohibit the use of AI in the process of artwork being posted. ArtStation is a portfolio platform designed to elevate and celebrate originality powered by a community of artists. The works on your portfolio should be work that you created and we encourage you to be transparent in the process. Please only publish work that either you own or that you have permission to publish. We believe that your projects are your own, and you have the right to control how they are used.
Does ArtStation have business deals with AI art generators?
No. As part of our Terms of Service, all of the artwork you post on ArtStation belongs to you. We will not sell or license your artwork to other companies.
Epic does not make any agreements with companies allowing them to scrape content on our website. Any use of ArtStation content that is not consistent with our terms of service may be an infringement on the rights of ArtStation users.
What recourse do I have if someone uses my work without my permission?
We take copyright infringement seriously and it is our goal to provide a professional environment for artists to show their work.
